Bayardo E. Alemán is a founding partner of Alemán Law. He regularly handles high-stakes cases covering sensitive subject matters in all areas of labor & employment law, including employment discrimination, retaliation, whistleblower lawsuits, and sexual harassment lawsuits. Bayardo has extensive experience litigating non-competition and non-solicitation agreements, and wage and hour lawsuits in a wide range of industries. Bayardo also counsels clients on day-to-day human resources issues and frequently speaks and conducts training on labor & employment issues in English and Spanish. Prior to joining the Firm, Bayardo was a partner at one of Florida’s most-well respected full-service firms.

Bayardo has been recognized by Florida Super Lawyers as a “Rising Star” every year from 2017 through 2021 and as a “Super Lawyer” in 2022 and 2023. He has also been included in the 2024 & 2025 edition of The Best Lawyers in America® for his work in the fields of Employment Law, Labor Law – Management and Litigation – Labor and Employment.  In addition to the accolades earned for his defense and management practice, Best Lawyers in America® named Bayardo its 2025’s “Lawyer of the Year” for the region, in its Employment Law – Individuals category. Between 2018 and 2023, Benchmark Litigation has named Bayardo, a “A Top Litigator Under 40,” a “Labor and Employment Star” and a “Future Star.” That publication also named him to its “40 & Under Hot List” from 2018 through 2020. Bayardo was named a “Top Lawyer” by the South Florida Legal Guide in 2020, 2021, and 2022. In 2021 and 2022, Bayardo was named to Florida Trend’s “Legal Elite” – a recognition given to only 1,263 attorneys in the State of Florida (just over 1%). Bayardo was also named a top “40 Under 40 Outstanding Lawyers of South Florida” by the Cystic Fibrosis Foundation in 2016. He earned his J.D., cum laude, from the University of Florida Levin College of Law. A proud Gator, in 2019, Bayardo was named among the University of Florida’s “Top 40 Under 40 Outstanding Young Alumni.”

Bayardo moved to the U.S. from Nicaragua at the age of 8, and remains deeply committed to the Hispanic community. Through the Cuban American Bar Association’s Pro Bono Immigrant Minors Project, Bayardo has represented unaccompanied immigrant children who have fled poverty and violence in Central America, obtaining U.S. permanent visas for them. He also serves as guardian ad litem and volunteers at legal clinics where he advises low-income individuals on landlord/tenant, immigration, and employment issues, and a domestic violence center where he provides legal advice on employment rights to victims of domestic or sexual violence.

Although the Firm represents companies and public entities, it also proudly represents individuals in high-stakes matters. As a first-generation immigrant raised by hard-working parents who instilled the importance of a tireless work ethic, compassion, and integrity, Bayardo knows the importance of helping those in need and of what it takes to achieve just results.

Representative Experience

 Counseled national and international companies in all areas of labor and employment law, including conducting comprehensive due diligence of companies targeted for acquisition.

Successfully defended arbitration grievances on behalf of the multinational concessionaire, resulting in the upholding of Collective Bargaining Agreement provisions and management rights.

Obtained summary judgment victory in state court (and successfully defended the appeal) for a multinational restaurant chain sued for sexual harassment.

Obtained summary judgment victory in federal court for multinational food distributor against former employee seeking overtime wages due to alleged misclassification.

Obtained permanent injunction on behalf of multinational food distributor against former employee in violation of non-competition agreement.

Obtained permanent injunction on behalf of multinational bank against former employee in violation of non-solicitation agreement.

Successfully defended several arbitration grievances on behalf of international sugar producer, resulting in the upholding of discipline for employee misconduct.

Successfully defended multinational food distributor in lawsuit alleging violation of a non-competition agreement.

Obtained victory for bank client in state court lawsuit brought by former employee claiming unpaid wages.

Obtained summary judgment victory in state court for aerospace company in lawsuit brought by former employee claiming whistleblower status and alleging retaliation, and successfully defended appeal of state court’s dismissal.

Successfully secured dismissal of over 30 lawsuits in state and federal courts arising out of the denial of health benefits claims.

Obtained summary judgment victory in state court for healthcare company seeking to enforce non-competition agreement against former employee.

Obtained summary judgment victory in federal court for educational institution in lawsuit brought by former employee alleging pregnancy discrimination.

Obtained summary judgment victory in federal court for multinational bank in lawsuit brought by former temporary employee alleging sexual harassment and retaliation.

Obtained summary judgment victory for international hotel in lawsuit alleging disability discrimination and retaliation by former employee.

Obtained summary judgment victory in state court for national supermarket chain manager in lawsuit by former employee alleging tortious interference with a business relationship.

Obtained summary judgment victory in state court for local hospitality client in lawsuit brought by former employee for unpaid wages following employee’s termination.
